In a previous blog post, I discussed how Utah House Bill 43 (HB 43) simplified charitable organization registrations. I stand corrected. As it turns out, the copy of HB 43 that I was referencing was not the final version. In its final form, HB 43 eliminated the annual registration requirement for charitable organizations by completely repealing Utah Code section 13-22-6.
If you have recently visited the Charities section on the Utah Division of Consumer Protection website (Charities - dcp.utah.gov), you would have found this announcement:
During the 2024 legislative session, the Utah Legislature passed H.B. 43, Charitable Solicitations Act Amendments. Effective May 1, 2024, charitable organizations will no longer be required to submit an annual registration with the Utah Division of Consumer Protection.
Beginning April 2, 2024, the Utah Division of Consumer Protection will no longer accept charitable organization registrations.
Charitable organizations will continue to file their incorporation documents with the Utah Division of Corporations and Commercial Code.
Under the new law, certain charities will be required to upload their most recent Form 990 as part of the corporation's filing process. The Division will promulgate new Administrative Rules that reflect these changes.
More information will be posted on the Utah Division of Consumer Protection’s website throughout the year regarding the application process. Please check back periodically to review this page for future updates that may impact your charitable organization.
As mentioned in the Announcement, certain charities will be required to upload their most recent Form 990 as part of the corporation’s filing process. This requirement will become effective January 1, 2025.
